Description

To provide strategic planning advice and co-ordinate a planning application for Substitute Consent from An Bord Pleanála in order to regularise the planning status of the existing glass recycling facility. The requirement for Substitute Consent arose from a recent change in legislative interpretation regarding the definition of waste recovery and the need for Environmental Impact Assessment.

Our Role

Tom Phillips + Associates (TPA) provided strategic planning advice regarding the planning status of the existing facility including a detailed overview of the relevant planning and environmental law provisions governing this form of development and case law as relevant. A detailed analysis of the site’s planning history was also carried out, which enabled an agreed planning strategy to be formulated with the Client and the design team to progress matters.
TPA co-ordinated and lodged the initial application seeking Leave to Apply for Substitute Consent and on its receipt, prepared and lodged the substantive Substitute Consent application with the Board.
During the course of the planning process, TPA liaised closely with Kildare County Council and co-ordinated the pre-planning discussions with An Bord Pleanála and part-authored, reviewed and lodged the application documentation including the remedial EIS.

Planning Outcome

In June 2014, An Bord Pleanála issued a grant of substitute consent for the subject facility, one of the first of this type of permission granted since the relevant legislation was enacted.
